Terms of Service
GENERAL
1.1. The owner of the Primeshoe online store (hereinafter referred to as the Online Store) is MindMentor OÜ, reg. no. 16901805.
1.2. These terms of use govern the legal relationships arising between MindMentor OÜ (Seller) and the person making a purchase (Buyer) during the purchase and sale in the Online Store.
1.3. In addition to these terms, the legal relationships arising from the marketing of products through the Online Store are governed by the laws of the Republic of Estonia.
1.4. The Seller may change the terms of use of the Online Store and the prices of products and services. Any changes will be announced in the Online Store environment. The terms and prices applicable at the time of the transaction shall apply to the transaction.
1.5. The selection of products, prices, and discounts may differ from those in the Seller’s physical stores, as well as from their prices and discounts.
PRICE
2.1. Information about the product is provided directly next to the product in the Online Store and includes VAT at the rate of 22%, applicable in the Republic of Estonia.
2.2. Product prices are displayed next to the products in the Online Store. The price does not include the cost of delivery unless otherwise stated during payment. Delivery costs depend on the Buyer's location and the chosen delivery method. The delivery fee will be displayed to the Buyer when placing the order.
2.3. The Online Store reserves the right to withdraw from a sales transaction and reclaim the product if the price in the Online Store has been significantly lower than the market price due to an error.
PLACING AN ORDER
3.1. To place an order, the desired products must be added to the shopping cart. To complete the order, the required fields must be filled out, and the preferred delivery method must be selected.
3.2. Products and quantities in the shopping cart can be changed, and products can be removed from the cart until the payment has been made.
3.3. Upon completing the order, the final price will be displayed on the screen, which can be paid using a bank link or another payment solution.
3.4. The contract is considered valid once the payable amount has been credited to the Online Store's account.
3.5. The Seller will send the order confirmation notice to the Buyer via email. If the email is not found, please check the spam folder.
3.6. The Seller reserves the right to cancel the contract if the ordered product cannot be delivered due to stock depletion or for any other reason. The Seller will inform the Buyer as soon as possible and refund the full payment (including delivery fees) promptly, but no later than within 14 days of sending the notice.
PAYMENT
4.1. The Buyer shall pay for purchases made in the Online Store 100% in advance.
4.2. Orders can be paid via Estonian bank links (Montonio), Paypal, Adyen credit card, or by invoice.
4.3. Payments are processed in a secure environment outside the Online Store. The Seller does not have access to the Buyer's bank or credit card details.
DELIVERY
5.1. The Online Store delivers products within Europe.
5.2. Products are delivered according to the method selected by the Buyer in the Online Store.
5.3. Delivery costs are borne by the Buyer, and relevant pricing information is displayed next to the delivery method.
5.4. The Seller ships orders on all business days, but no later than five business days after the order confirmation. In exceptional cases, the product may be delivered within 45 calendar days, particularly for special orders.
RIGHT OF WITHDRAWAL, PRODUCT RETURN, AND EXCHANGE
6.1. The Buyer has the right to withdraw from the transaction within 14 calendar days by submitting a written notice of withdrawal to the Seller, which must include the following information:
- First and last name
- Contact phone number
- Email address
- Address
- Bank account details
- Order date
- Date of receipt of the item
- Name of the product being returned
- Order number of the product
- Reason for the return
6.2. The withdrawal notice must be sent to the email address: kaarel@primeshoe.eu. The Seller will confirm receipt of the withdrawal notice via an email notification.
6.3. The returned product must include all original documentation. Tags and protective items (e.g., protective films, moisture collectors, plastic wrappings) must remain attached and intact for return, as long as they do not prevent product inspection or fitting.
6.4. To use the 14-day right of return, the ordered product must not be used for any purpose other than to inspect the nature, features, and functioning of the product, as is allowed in a physical store. If the product has been used for any other purpose or shows signs of use or wear, the Seller reserves the right to reduce the refund amount in accordance with the depreciation in the value of the product or refuse to refund the product altogether.
6.5. Return conditions apply to standard-sized products. Special orders and customized products are not eligible for return.
6.6. The Buyer may exchange the ordered product within 14 calendar days of receiving it if the product size is unsuitable. The return conditions in 6.1–6.5 apply to the return of products with unsuitable sizes.
6.7. If the returned product cannot be exchanged due to the unavailability of the desired size, the Seller will contact the Buyer to propose a solution.
6.8. The Buyer is obliged to return the product within 14 calendar days from the day the withdrawal notice is submitted.
6.9. The Seller is not responsible for the product until it is received by the Seller. Returning or exchanging the product is free of charge, except for the return shipping costs, which are borne by the Buyer. If the product is returned due to defects, the Seller will bear the return costs.
6.10. The Seller will refund the Buyer for the returned product immediately, but no later than 14 days from receiving the withdrawal notice, including transportation costs. If the Buyer explicitly chose a delivery method more expensive than the most standard option offered by the Online Store, the Seller is not obliged to refund the cost difference between these methods.
6.11. The Seller reserves the right to delay refunding payments until the product subject to the contract has been returned.
6.12. The Seller reserves the right to withdraw from a sales transaction and reclaim the product if the price in the Online Store was significantly lower than the market price due to an error.
RIGHT TO FILE A CLAIM
7.1. The Seller is responsible for any product defects or non-conformity with the contract terms that existed at the time of delivery to the Buyer and that emerge within two years of delivery. For the first six months, it is presumed that the defect existed at the time of delivery, unless the Seller can prove otherwise. The Seller is not liable for defects that occur after the product has been delivered to the Buyer.
7.2. The Buyer must notify the Seller of any product defects within two months of discovering them by sending an email to kaarel@primeshoe.eu.
7.3. In the case of non-conformity or defects, the Buyer has the right to demand repair or replacement of the product with a product that meets the requirements or to return the product at the Seller’s expense.
7.4. The Buyer has the right to demand a price reduction or contract cancellation and a refund for the product if:
The Seller is unable to repair or replace the product
The repair or replacement fails
The Seller has not rectified the defect within a reasonable time.
7.5. If a defective product is returned, the Buyer will be refunded the price paid, along with shipping costs, to the bank account provided by the Buyer within 14 days. The Seller has the right to delay refunding until the Buyer returns the product.
7.6. For the first six months from delivery, the Seller will cover repair or replacement costs. For the remaining 1.5 years, the Seller will cover these costs only if the claim is justified. The Seller will not compensate the Buyer for expenses related to product defects if:
The product has been damaged by the Buyer
The defects have arisen due to improper use or failure to follow the maintenance instructions
The product’s value has decreased due to normal wear and tear
The Buyer cannot provide proof of purchase.
7.7. If the Buyer and Seller cannot reach an agreement regarding product defects, the Buyer can submit a complaint to the Seller, stating their name, contact information, the date of the complaint, the defect found, and the desired solution. The Seller will respond to the complaint within 14 calendar days. Complaints regarding the Online Store can be sent to kaarel@primeshoe.eu.
7.8. If the Buyer and Seller cannot resolve the dispute, the Buyer has the right to contact the Consumer Disputes Committee under the Estonian Consumer Protection Board for out-of-court resolution. The procedure and submission of a complaint can be found at https://www.tarbijakaitseamet.ee/et/tarbijavaidluste-komisjon. The Consumer Disputes Committee's decisions are based on the laws of the Republic of Estonia. The Buyer may also use the European Union’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/main/index.cfm.
7.9. If the decision of the Consumer Disputes Committee is unsatisfactory, both parties have the right to take the dispute to the court in the Buyer's location.
PROCESSING OF PERSONAL DATA
8.1. The controller of personal data is MindMentor OÜ (registration number: 16901805).
8.2. The processing of personal data is carried out in accordance with the laws of Estonia and the European Union.
8.3. The controller collects the following personal data: name, phone number, address, email address, bank account details. These data are used solely for processing the order and delivering the goods to the Buyer. The Seller transfers personal data to courier companies for the purpose of delivering the goods.
8.4. Personal data submitted to the controller are protected and treated as confidential information. Data transmission between the customer and banks is encrypted. The data controller does not have access to the Buyer's confidential bank or credit card details. The controller does not disclose any personal information to third parties.
8.5. The controller may send newsletters, satisfaction surveys, and offers to the Buyer’s email address only if the Buyer has given prior consent.
8.6. The Buyer has the right to file a complaint with the Data Protection Inspectorate or the court if they believe that their rights have been violated during the processing of personal data. Contact details for the Data Protection Inspectorate (AKI) can be found on the AKI website at www.aki.ee.
